 In a report published on Business Today, Raj Lakhotia, founder of Dilsewill, says that in case of divorce, if the wife separates from her husband or is abandoned by the husband, then she can get the husband’s property in addition to the 50 percent share in her name. She can also ask for her share. Whereas if both husband and wife have jointly paid for a property and have ownership over it, then the wife can demand her share from the husband’s share in addition to her 50% share.

In many divorce cases where the property is completely in the husband’s name and even then in the event of divorce, the wife can claim maintenance as she is considered the class first legal heir. On the other hand, if the wife has provided financial help in the property registered in the name of the husband, then the husband can keep his claim on that property until the wife proves it by giving evidence of her contribution in it. Apart from this, the property purchased by the wife herself is completely hers and she has complete freedom to sell, keep or gift these properties.

 Rights of maintenance

 During legal separation, a woman can claim maintenance for herself and her children under Section 125 of the Indian Penal Code.  According to Section 25 of the Hindu Adoption and Maintenance Act 1956, the wife can get maintenance either as a lump sum or as monthly payments fixed by the court. If there is sufficient disparity in income between husband and wife, a working woman can also get alimony. Lakhotia says that in case of divorce, the woman can also claim the jewelery and stridhan held by her in-laws and failing that, she can seek relief under Section 14 of the Hindu Succession Act 1956 and Section 27 of the Hindu Marriage Act 1955.
